Apart from the areas of land mentioned below, this Act applies to any land which is open to the air and to which the public are entitled or permitted to have access.

The Act does not apply to the following sorts of land:

Carriageways with a speed limit of more than 40mph and land running alongside them

Land used for agriculture or for woodland

Land which is predominately marshland, moor or heath

Rural common land.

Penalties for the Offence of allowing your dog to foul:

If a dog defecates at any time on designated land and a person (other than a registered blind person) who is in charge of the dog at the time, fails to remove the faeces from the land, that person shall be guilty of an offence.

Dacorum Borough Council has approximately 430 dog bins across the district for the disposal of dog waste. You can be issued with a fixed penalty notice, currently £75, if you are witnessed not clearing up after your dog or you can be taken to court and face a fine of up to £1,000.

On an occasion where an authorised officer finds a person who he has reason to believe has committed an offence under this Act; he may issue that person with a fixed penalty notice. Offenders may be given the option of paying the penalty, which stands at £75, within 14 days thus discharging any liability to conviction by a court.

Placing the faeces in a receptacle, which has been provided for that purpose by the Council, shall be sufficient removal from the land.
