Dangerous Dogs Act 1991
Section 3 of this Act refers to dogs of all types
and makes it a criminal offence to allow any dog to be dangerously
out of control in a public place, or a private place where the
dog has no right to be.
A dog is regarded as being “dangerously out
of control” if there are grounds for suspecting that it
will injure a person whether or not it actually does. If no injury
is caused a fine of £2,000 or 6 months imprisonment can
be imposed. For actual injury the penalty is 2 years imprisonment
and/or an unlimited fine and in certain cases, destruction of
the dog. A court can specify muzzling or leashing or disqualify
the owners from custody of the dog for any period.
